1. About Brisa Bikes

Brisa Bikes provides electric bicycle rentals, including delivery and collection within its designated service area in Catalonia, Spain. The service is operated by Victor Gonçalves de Miranda, a self-employed professional (autónomo) in Spain. Contact: hello@brisabike.com. Full operator details are provided in the Legal Notice.

These Terms apply to bookings made through the Brisa Bikes website and form part of the rental agreement presented to customers before completing an order.

2. Bookings, rental periods & prices

Customers select their rental dates and number of bicycles through the website. A booking is subject to availability and confirmation by Brisa Bikes, and to successful payment where payment is required.

Rental periods are calculated in calendar days, including the delivery and collection dates. A one-day rental is not a 24-hour rental. Longer rental periods may benefit from the prices displayed in the booking system.

All prices and charges payable for a booking are displayed before the customer submits the order. Changes requested after confirmation are subject to availability and any price difference agreed in advance.

3. Equipment included

Each rental includes one Trek Verve+ 4 Lowstep electric bicycle, one bicycle helmet, one pannier bag, one ABUS U-shaped bicycle lock with its keys, and one separate security chain. A battery charger is also included when supplied at handover. A phone holder is not included.

Delivery and collection are free within the eligible standard service area shown on the website.

4. Delivery & collection

Standard delivery and collection hours are 9:00 AM to 6:00 PM. Exact delivery and collection arrangements are agreed with the customer after booking, subject to operational availability. Requests outside these hours may be considered but cannot be guaranteed.

The customer must provide an eligible and accurate address and ensure that an authorised person is available at the agreed delivery and collection times.

If Brisa Bikes cannot offer suitable delivery arrangements before the rental starts, the customer may choose an alternative available date or receive a full refund of the affected booking.

5. Cancellations, changes & refunds

For cancellations received more than 30 calendar days before the first booked rental date, customers receive a 100% refund of the rental price. For cancellations received between 30 and 7 calendar days before the first booked rental date (inclusive), customers receive a 50% refund of the rental price.

For cancellations received less than 7 calendar days before the first booked rental date, the rental price is normally non-refundable, except where mandatory consumer rights require otherwise. The cancellation date is the date the request reaches our email inbox, using local time in Catalonia. Requests to change dates remain subject to availability.

If Brisa Bikes cancels the booking or cannot provide the agreed rental service, the customer will receive a full refund for the service not provided, or may accept an alternative arrangement.

This policy applies to the rental price, not any separately collected refundable security deposit. Mandatory statutory rights of withdrawal or refund take precedence over this policy. Cancellation requests should be emailed to hello@brisabike.com.

6. Responsible use & rider safety

Ride responsibly, follow applicable traffic rules and use the bicycle only within the rider’s abilities.

Wear a helmet whenever required by law, and follow equipment and safety instructions.

Whenever the bicycle is left unattended, secure it using BOTH the supplied ABUS U-shaped lock AND the separate security chain. Use both devices to secure the bicycle to a fixed, immovable object wherever reasonably possible. Do not leave the bicycle unattended if it cannot be secured appropriately. Take reasonable precautions against theft.

Do not lend, sublet or transfer the bicycle to unauthorised riders.

Respect the bicycle’s specifications, permitted load, and intended use. Do not tamper with the motor, battery or electrical components.

If an available bicycle cannot be safely adapted to the intended rider and no suitable substitute can be provided, Brisa Bikes will refund the affected rental.

7. Damage, theft, loss & non-return

The customer must take reasonable care of the bicycle and accessories and return them in substantially the same condition, allowing for ordinary wear and tear. Any accident, damage, theft, loss or malfunction must be reported promptly to Brisa Bikes. In the event of theft, the customer should report the incident to the police and provide the relevant report where available.

Where loss or damage is legally attributable to the customer, Brisa Bikes may seek reasonable, documented costs necessary to repair or replace the affected property. No charge is made for normal wear, pre-existing defects or damage not attributable to the customer.

The customer is responsible for damage, loss or theft only to the extent legally attributable to them, including failure to take reasonable precautions or to follow the agreed requirement to use BOTH the ABUS U-shaped lock and the separate security chain whenever the bicycle is left unattended. Theft or accidental damage does not automatically establish customer liability; the circumstances and available evidence will be considered.

For a stolen or unreturned bicycle, any compensation due will be determined by the bicycle’s justified market value at the time of the incident, considering its age, condition and comparable equipment. Neither the original purchase price nor a fixed replacement penalty is applied automatically. Any insurance compensation received for the same loss will be taken into account to prevent double recovery.

For damaged electrical displays and other bicycle components, where the customer is legally responsible, charges are based on necessary, documented repair or replacement costs. For a supplied battery charger that is lost, not returned or damaged through misuse or lack of reasonable care, the indicative replacement value is €30, subject to the actual justified loss. No charge is made for ordinary wear, pre-existing defects or faults not attributable to the customer.

Reference replacement values for missing accessories

These values are indicative references for loss, non-return or damage attributable to the customer, not automatic penalties or additional security deposits. Any amount charged must reflect a reasonable and justifiable loss. The €30 charger reference applies only when a charger was supplied at handover.

AccessoryReference value
Helmet€25
Pannier bag€30
ABUS U-shaped lock (complete)€20
ABUS U-lock key(s) (lost separately)€10
Separate security chain€30
Battery charger (if supplied)€30

The ABUS U-lock and its keys will not be charged separately when the entire U-lock is missing, unless an additional, documented loss is incurred. The separate security chain is a distinct item and may be assessed independently if it is missing or damaged.

8. Security deposit

A refundable security deposit of €150 per bicycle may be required, provided that its amount, purpose and payment arrangements are clearly disclosed before the customer places the booking. It is separate from the rental price and is not an additional rental charge. If no deposit requirement was disclosed before booking, no deposit will be imposed afterwards for that booking.

For bookings made at least 7 calendar days before the first rental date, Brisa Bikes will normally send a booking reminder and a secure, separate deposit payment request approximately 7 days before the rental starts. For bookings made less than 7 days in advance, the request will be sent promptly following confirmation. The deposit must be paid before the bicycle is handed over. If payment is outstanding, Brisa Bikes will contact the customer to resolve the situation before delivery, subject to mandatory consumer rights.

Following return and reasonable inspection of the bicycle and accessories, the deposit will be refunded promptly within the timeframe communicated to the customer. Any proposed deduction must relate to a loss or damage legally attributable to the customer and be reasonable, explained and supported by evidence. The customer will be informed of any justified unresolved claim.

The deposit is security, not insurance, and does not cap the customer’s liability for proven, legally recoverable losses. No separate deposit will be added automatically to the rental payment, and no later card charge will be made without an appropriate, previously disclosed payment authorisation. Applicable consumer rights remain unaffected.

9. Mechanical problems & assistance

If a mechanical or electrical problem arises, the customer should stop using the bicycle where continued use could be unsafe and contact Brisa Bikes promptly.

Brisa Bikes will assess the issue and offer reasonable assistance, repair, replacement or an appropriate refund where required by applicable consumer law. Customers should not arrange non-emergency repairs at Brisa Bikes’ expense without prior agreement.

10. Late returns

The bicycles must be available at the agreed collection time and location. Customers should notify Brisa Bikes as soon as a delay becomes likely. Reasonable minor delays will be handled pragmatically.

If a delay attributable to the customer prevents collection on the agreed date and extends the rental into an additional calendar day, an extra €45 will be charged per affected bicycle for that additional day. This charge does not apply to delays caused by Brisa Bikes or circumstances for which the customer is not responsible. Any further extensions require prior agreement.

11. Handover & equipment checks

At delivery and collection, Brisa Bikes may record the bicycle’s condition, serial number and included accessories, including by photographs. This may include the helmet, pannier bag, ABUS U-shaped lock and keys, separate security chain and battery charger (where supplied). Customers are encouraged to point out any visible issue at handover.

Customers should return the ABUS U-lock with all its keys, the separate chain, the helmet, pannier bag and any supplied battery charger together with the bicycle. Equipment must not be left unattended at the collection point unless specifically agreed.

12. Liability & consumer rights

Nothing in these Terms excludes or restricts any liability that cannot lawfully be excluded, including liability arising from Brisa Bikes’ failure to meet its legal obligations. Customers retain all mandatory rights under applicable consumer protection law.

These Terms do not represent a promise of specific theft, accident or personal insurance cover. Any insurance cover actually provided will be described separately and accurately.

13. Questions, complaints & privacy

For questions, changes, cancellations or complaints, contact hello@brisabike.com. Official consumer complaint procedures remain available where required by law.

Personal data collected in connection with bookings is handled as explained in the separate Privacy Policy.

14. Applicable law

The agreement is governed by applicable Spanish law, without prejudice to mandatory consumer rights and any legally applicable rules on jurisdiction. These Terms do not require consumers to bring disputes before a court that is not competent under applicable law.
